The decision of the Court of Appeal to clear the case of Christian Vanneste is making uproar among the LGBT community. Act-up Paris, the Sneg and SOS Homophobie which had obtained the condemnation estimates that this decision is not in accordance with the law of December 2004 allowing proceedings in court for homophobic insults. Indeed with such an interpretation, homophobic speech would now form part of the freedom of expression. The associations are now to present the case in the European Court of human rights.
